Q. What is collaborative family law?

A. Collaborative family law deals with divorce in a dignified manner and allows both parties to reach a civil settlement.

Q. How does the collaborative family law process work?

A. By using collaborative family law, both parties can still have a solicitor representing them but they meet in a more relaxed environment and work together to resolve child and financial issues arising out of the separation.

For an increasing number, it's an ideal solution if they want to avoid traditional to-ing and fro-ing with solicitors or do not wish to go through mediation.

A settlement is reached through four-way meetings with the couple and their respective solicitors. Each party must disclose all information and the collaborative lawyers will work in a non-confrontational way with the other party to reach a resolution. Should a unanimous agreement not be reached then court proceedings would begin.

Q. What are the benefits of collaborative family law?

A. By using this process, a couple can amicably and calmly come to an agreement concerning their financial situation and, more importantly, focus on the needs of any children involved. It creates better communication between the couple and speeds up the settlement process.

Q. What are the costs?

A. By using collaborative family law you cut out the need for a court hearing and therefore reduce the costs of agreeing the settlement.

Q. Why have I not heard about collaborative family law before?

A. Collaborative family law was only introduced in 2004 but since then has proved popular and extremely successful and is expanding across the country.

Q. How do I set up a collaborative family law meeting?

A. You can find a list of collaborative family lawyers at www.collabfamilylaw.org.uk
